I am pleased to announce that I will be co-presenting with Neil Beaton, CPA and Ben Thomas, CPA of Alvarez & Marsal Valuation Services of Seattle, WA. in an upcoming Strafford live webinar, “Divorce Under Tax Reform: Eliminating Support Payment Tax Benefits and Other Changes” scheduled for Wednesday, April 11, 1:00pm-2:30pm EDT.

The changes implemented by this major tax reform are expected to reshape how family law attorneys address many common issues in their practice. The new law impacts issues like the treatment of alimony, personal exemptions, standard deductions, child tax credits, home mortgage and home equity loan interest, limitations on deductions for state and local tax, increases in the estate and gift tax exemptions, corporate taxes and the related impact on business valuations, expansion of expenses that can be paid from a 529 Plan and many more. One shift with the broadest impact on divorcing parties is the elimination of the tax deduction for alimony. Alimony will no longer be deductible by the payor or taxable to the payee, requiring practitioners to shift their focus to the parties’ after-tax incomes to determine the appropriate amount of support.

This practical webinar will prepare family law practitioners and financial experts to better represent litigants in identifying, classifying and valuing stock options and restricted stock units (RSUs) for purposes of both equitable distribution and income availability upon divorce or in the context of post-judgment modification. You will learn about the different types of stock options and RSUs, the identification, consideration and distribution of these stock options and RSUs in the matrimonial context, and the appropriate valuation methods for such stock options in the divorce and post-divorce context. Among other things, you will learn about:

Gray areas where specific attention to the details surrounding the nature and purpose of the stock option need to be carefully analyzed to avoid inappropriate distribution or inaccurate assumptions regarding pre-marital, marital or post-marital assets and income.
The difference between a vested and unvested stock option
How to identify different stock options
What “time rules” are used in various venues
What different valuation methods can be applied to value a stock option, and under what specific circumstances the different valuation methods should be applied
When stock options should be considered as marital assets subject to equitable distribution, and under what circumstances stock options can and/or should be considered income
How one equitably distributes a stock option

Charles Vuotto co-presented at the New Jersey Society of CPAs joint Divorce Conference.

He, along with other experienced divorce practitioners, discussed developments and the growing debate among experts in the case law regarding the allocation of certain assets to the marital estate for equitable distribution purposes. The speakers discussed trends in Court decisions for both in-state cases and precedent being formulated in other states in this realm, in the context of both the growth of businesses and other (at least partially) active assets acquired before marriage and/or after the Complaint for Divorce is filed.

The presenters briefly discussed the emerging concepts of “extraordinary circumstances”, as defined in New Jersey’s Brown v. Brown decision.

Mr. Vuotto spoke with Paul Gazaleh, CPA of the Chalfin Group, Inc., of Metuchen, New Jersey. This program covered an overview of the matrimonial engagement from the perspective of the accountant, preparation of lifestyle and cash flow analyses, calculating income available for support (stock options as income), assessing complex asset valuations including closely-held businesses (with emphasis on the recent case ofBrown v. Brown and the standard of value), valuing and distributing stock options, valuing and distributing retirement/deferred compensation plans and discussing relevant case law.
