Domestic Violence Orders

Our Courts have rejected the suggestion that a one-year time period be engrafted onto New Jersey’s Domestic Violence Statute (N.J.S.A. 2C:25-29d) related to the duration of Final Restraining Orders. Such a determination is deferred for legislative action. The linchpin in any motion addressed to dismissal of a final restraining order is whether there have been substantial changed circumstances since its entry that constitute good cause for consideration of dismissal.” Kanaszka v. Kunen, 313 N.J. Super. 600, 608 (App. Div. 1998).
